The National Data Protection Authority (ANPD) recently published in the Official Gazette the notices for the formation of triple lists for the composition of the National Council for the Protection of Personal Data and Privacy (CNPD) regarding the representatives of society, according to the criteria the candidate’s representativeness and experience in protecting personal data and related areas. The triple list will be submitted by the ANPD to the Minister of State Chief of Staff of the Presidency of the Republic.<\/p>\n
The CNPD is an advisory body that integrates the organizational structure of the ANPD, composed of 23 representatives, from the Executive and Legislative Powers, the National Council of Justice, the National Council of the Public Ministry, the Internet Steering Committee, scientific institutions, representative entities and union confederations. The other members of the CNPD, linked to government agencies, are directly appointed by the holders of the bodies they represent. However, all of its members are required to have a qualification compatible with the activities of the CNPD, which will serve two-year terms, with a renewal permitted.<\/p>\n
CNPD’s competence includes initiatives to disseminate knowledge about privacy and data protection (studies, debates, public hearings) and support to ANPD (proposal for strategic guidelines and actions, evaluation reports), particularly with regard to National Policy in this regard. area. In addition, the advisory body should also be heard when setting the standards and techniques used in anonymization processes.<\/p>\n
The ANPD also made public its strategic planning (2021-2023) with three main objectives with which specific actions and indicators are associated: promoting the strengthening of the culture of protection of personal data (opening to dialogue, organizing events and guides to good practices) ); establish an effective regulatory environment for the protection of personal data (LGPD operational initiatives and regulations); improve the conditions for compliance with legal competences (budgetary, structural and legal aspects).<\/p>\n
